×This Privacy Policy for Personal Data (the “Privacy Policy”) applies to all information that the online store “MST Nutrition” at https://mstnutrition.ua/ may obtain about the User while the User is using the online store’s website, programs, and products.
1.1. The following terms are used in this Privacy Policy:
1.1.1. “Website Administration of the Online Store” (the “Website Administration”) – authorized employees responsible for managing the website on behalf of the online store “mstnutrition.ua”, who organize and carry out the processing of personal data, and determine the purposes of personal data processing, the scope of personal data to be processed, and the actions or operations performed with personal data.
1.1.2. “Personal Data” – any information relating directly or indirectly to an identified or identifiable natural person (the data subject).
1.1.3. “Processing of Personal Data” – any action (operation) or set of actions (operations) performed with or without automation tools on personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), anonymization, blocking, deletion, and destruction of personal data.
1.1.4. “Confidentiality of Personal Data” – a requirement binding on the Administrator or any other person who has gained access to personal data not to disclose such data without the consent of the data subject or other lawful grounds.
1.1.5. “User of the Online Store Website mstnutrition.ua” – a person who has access to the Website via the Internet and uses the online store’s Website.
1.1.6. “Cookies” – a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request each time the user attempts to open a page of the relevant website.

3.1. This Privacy Policy establishes the obligations of the Website Administration regarding non-disclosure and ensuring the protection of the confidentiality of personal data that the User may be required to provide to the Website Administration when registering on the online store website or when placing an order to purchase Goods.
3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling in the registration form on the online store website mstnutrition.ua and includes the following information:
3.2.1. User’s full name;
3.2.2. User’s contact phone number;
3.2.3. email address (e-mail);
3.2.4. delivery address for the Goods;
3.2.5. User’s place of residence.

4.1.11. Carrying out advertising activities with the User’s consent.
4.1.12. Providing the User with access to partners’ websites or services to obtain products, updates, and services.
5.1. The User’s personal data is processed for the period necessary to achieve the purposes of processing, fulfill the order, and comply with the requirements of Ukrainian law, by any lawful means, including in personal data information systems using automation tools or without such tools.
5.2. The User agrees that the Website Administration has the right to transfer personal data to third parties solely for the purpose of fulfilling the order, ensuring Website operation, providing services and analytics, including:
— courier services, postal organizations, and delivery services — for delivering Goods;
— telecommunications operators and messaging services — to inform the User about the order;
— payment providers/banks — for payment processing;
— IT service providers (hosting, CRM/ERP, technical support) — to ensure Website operation;

5.3. The User’s personal data may be transferred to authorized state authorities of Ukraine only on the grounds and in the manner established by Ukrainian law.
5.4. In the event of loss or disclosure of personal data, the Website Administration informs the User about such loss or disclosure.
5.5. The Website Administration takes necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, distortion, blocking, copying, distribution, and other unlawful actions of third parties.
5.6. The Website Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.
6.1. The User is obliged to:
6.1.1. Provide personal data required to use the online store website mstnutrition.ua.
6.1.2. Update and supplement the provided personal data if such data changes.
6.2. The Website Administration is obliged to:
6.2.1. Use the received information exclusively for the purposes specified in Section 4 of this Privacy Policy.
6.2.2. Ensure confidentiality of the information, not disclose it without the User’s prior written consent, and not sell, exchange, publish, or otherwise disclose the User’s personal data, except as provided in clauses 5.2 and 5.3 of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User’s personal data according to the procedures commonly used to protect such information in business practice.
6.2.4. Block personal data relating to the relevant User from the moment of the User’s request or the request of the User’s legal representative or an authorized body for the protection of data subjects’ rights for the period of verification if inaccurate personal data or unlawful actions are detected.
7.1. The Website Administration that fails to fulfill its obligations is liable for losses incurred by the User in connection with unlawful use of personal data, in accordance with Ukrainian law, except for the cases provided in clauses 5.2, 5.3, and 7.2 of this Privacy Policy.
7.2. In the event of loss or disclosure of confidential information, the Website Administration is not liable if such confidential information:
7.2.1. Became publicly available before its loss or disclosure.
7.2.2. Was obtained from a third party before it was obtained by the Website Administration.
7.2.3. Was disclosed with the User’s consent.
8.1. Before filing a lawsuit in disputes arising from the relationship between the User and the Website Administration, it is mandatory to submit a claim (a written proposal for voluntary settlement of the dispute).
8.2. The recipient of the claim shall, within 30 calendar days from the date of receipt, notify the claimant in writing of the results of the claim review.
8.3. If no agreement is reached, the dispute shall be referred to a court in accordance with applicable Ukrainian law.
8.4. This Privacy Policy and the relationship between the User and the Website Administration shall be governed by applicable Ukrainian law.
9.1. The Website Administration has the right to make changes to this Privacy Policy without the User’s consent.
9.2. The new Privacy Policy enters into force from the moment it is posted on the online store website, unless otherwise provided by the new version of the Privacy Policy.
